1. Overview
These Terms of Service ("Terms") apply to your use of arcform, a web-based software service for engineering governance, architecture decision records, approvals, and decision tracking.
arcform is provided for business use. By accessing or using the service, you agree to these Terms on behalf of yourself and, where applicable, the organisation you represent.
If you are using arcform for an organisation, you confirm that you have authority to accept these Terms on that organisation's behalf.
2. Accounts and Organisations
Use of arcform requires an account. Accounts are associated with one or more organisations and may be assigned roles and permissions by organisation administrators.
- You must provide accurate account information and keep it up to date.
- You are responsible for safeguarding your login credentials and access to your account.
- Organisation administrators are responsible for managing membership, permissions, and access within their organisation.
- We may rely on administrator instructions regarding user access, suspension, or deletion within an organisation workspace.
3. Acceptable use
You agree not to use arcform to:
- break the law or infringe third-party rights;
- upload or transmit malicious code, malware, or harmful content;
- attempt unauthorised access, interfere with service security, or probe vulnerabilities without permission;
- reverse engineer, copy, or resell the service except as permitted by law or agreed in writing;
- use the service in a way that materially disrupts other customers or our infrastructure.
We may investigate suspected misuse and suspend access where reasonably necessary to protect the service, customers, or third parties.
4. Beta status disclaimer
arcform is currently in beta. Features may change, be removed, or be reconfigured as we improve the product. The service may contain bugs, incomplete functionality, or performance limitations.
During beta, you should not rely on arcform as your only record system for critical business decisions without your own backup and continuity measures.
5. Subscriptions and billing
Some features may be offered under paid subscriptions. Pricing, plan limits, and billing terms will be shown in the product or on our pricing page when paid plans are enabled for your organisation.
Beta and future billing flow
During beta, access may be free, trial-based, or provided under separate pilot terms. We may introduce a third-party payment processor (for example, Stripe) for subscription billing in the future.
Renewal, taxes, and non-payment
Unless otherwise agreed, subscriptions will renew on the stated billing cycle. Fees are exclusive of taxes unless stated otherwise. We may suspend access for overdue amounts after reasonable notice.
6. Data ownership
Customer owns their content
As between you and arcform, your organisation retains ownership of decision records, governance data, and other content you submit to the service ("Customer Content").
We process it to provide service
You grant us a limited right to host, process, transmit, and back up Customer Content only as necessary to provide, secure, support, and improve arcform in accordance with our Privacy Policy and these Terms.
7. Availability
We aim to provide a reliable service, but arcform is offered on an "as available" basis during beta. We do not provide a service level agreement (SLA) or guaranteed uptime at this stage.
We may perform maintenance, deploy updates, or temporarily restrict access to protect security and service integrity.
8. Termination
You may stop using the service at any time and request account or organisation closure.
We may suspend or terminate access if:
- you materially breach these Terms;
- we reasonably believe your use creates a security, legal, or operational risk;
- fees remain unpaid after notice (for paid plans); or
- we discontinue the beta service or a product component.
Where practical, we will provide notice and a reasonable opportunity to export data before termination, except where immediate action is required for security, legal, or abuse reasons.
9. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.
To the maximum extent permitted by law, arcform will not be liable for indirect, incidental, special, or consequential losses, including loss of profits, revenue, goodwill, or data.
To the maximum extent permitted by law, arcform's total liability arising out of or in connection with the service or these Terms will not exceed the greater of (a) the fees paid by your organisation to arcform for the service in the 12 months before the claim and (b) £100.
10. Indemnification
Your organisation agrees to indemnify and hold arcform harmless from claims, losses, and reasonable costs arising from Customer Content or your use of the service in breach of these Terms or applicable law, except to the extent caused by our breach of these Terms.
11. Changes to terms
We may update these Terms from time to time, including as arcform moves from beta to general availability. We will post the updated Terms on this page and update the "Last updated" date.
If changes are material, we will use reasonable efforts to provide notice (for example, by email or an in-product notice). Continued use of arcform after the updated Terms take effect means you accept the changes.
12. Governing law (England and Wales)
These Terms and any non-contractual obligations arising from or in connection with them are governed by the laws of England and Wales.
The courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or your use of arcform, unless otherwise required by applicable law.
